Many of you will be aware of and been a victim of sec172, the infamous piece of legislation which removes your right to silence when you are alleged to have committed a criminal offence (speeding etc) with a motor vehicle and you haven't been stopped and cautioned at the time - i.e. the piece of legislation that makes all those speed cameras work. Most probably won't be aware that sec172 has been the subject of a European Court of Human Rights challenge (O'Halloran & Francis vs UK). Should the ECHR challenge be successful, the coppers won't, unless they think of another method, be able to demand that you identify yourself as the criminal but will have to prove it was you in the saddle which is obviously a bit difficult with motorcyclists.

So why the posting? Because the judgement is due on 29 June at 8:30am BST. A summary of the verdict will be given orally by the President of the ECHR and should be available on the ECHR web site shortly afterwards.

Yes, I've been following this Maddog. The repercussions will reverbate for miles. Very Happy

On a motorcycle of course, they can't catch your registration unless they have a camera, like many that have been introduced South of the border, that swivels 180 degrees to catch the rear number plate as you pass.

I read not long ago about a guy traced 'through a distinctive' bike, one of only two in the area apparently. who gave the camera 'the bird'. Very Happy

Yeh right! If they can't trace that car that hit Diana's merc in the Pont de l'Alma tunnel how the hell could they catch a speeding motorcyclist. Confused

Much more likley they were monitoring one of the locum forums. Idea

I wonder if that means that everyone forced to provide the name of a driver can have their convictions quashed, their £60 returned and the points removed from their license Question Very Happy

(Don't you just hate words like license/licence; effect/affect; discrete/discreat Question I'm always bloody mixing them up grammatically Sad ).

Sorry guys, picked this up wrongly. I thought you meant the defenders lost their case i.e the UK legal system. Sad

Hardly see why it can be fair the way it stands at the moment. Is there an appeal planned Question

one of the problems over the reporting of these cases is that its not the uk legal system, its England and Wales with their set of laws and then Scotland with theirs.

I don't think the right to silence ever worked up here
